Terms of Service
Effective 18 May 2026.
These Terms of Service form a binding agreement between you and Shamarrway (referred to as "Shamarrway", "we", "us", or "our") and govern your access to and use of the Shamarrway website, dashboard, and shipping services (together, the "Services"). By creating an account or booking a shipment, you accept these Terms.
1. The Services
Shamarrway offers international shipping between the United States, the United Kingdom, and China on one side, and the Federal Republic of Nigeria on the other. The Services include rate quoting, consolidated forwarding, customs filing, transit tracking, and last-mile delivery. The exact list of supported origins, destinations, and shipping modes is shown in the dashboard at booking time.
2. Account registration
To use the Services you must register an account, give us accurate information, and keep it current. You must be at least 18 years old to contract with us. You are responsible for activity on your account, for keeping your credentials confidential, and for notifying us promptly if you suspect unauthorised use.
3. Pricing and payment
The price we quote at booking includes the base rate, weight and volume charges, applicable zone markup, any plan discount, declared-value insurance, and a pickup fee where you selected pickup. The quoted price is in United States Dollars; the Nigerian Naira equivalent shown is for reference only and is not a commitment to a specific exchange rate at settlement.
Payment is taken before the shipment leaves our origin warehouse. We use Stripe for USD, GBP, and EUR; Paystack for NGN; and Flutterwave for other African currencies. By submitting payment you authorise the relevant processor to charge your selected payment method.
4. Your obligations
You agree that:
- The contents you declare are accurate, complete, and lawful.
- You will package the parcel adequately for international transit.
- You will not ship any item listed in the Prohibited items section below.
- You will not under-declare value to reduce duties. We reserve the right to refuse, hold, or return any shipment we reasonably suspect of misdeclaration.
- You will respond to reasonable requests from us or customs authorities for additional information.
5. Prohibited items
A non-exhaustive list of items we do not ship is set out in our Acceptable-Use Policy. The Acceptable-Use Policy is incorporated into these Terms by reference. If you tender a prohibited item, we may dispose of it as permitted by law, suspend your account, and cooperate with authorities at our discretion.
6. Our obligations and timing
We will move your shipment in accordance with the mode you selected at booking, exercising reasonable commercial care. Transit times shown in the dashboard are good-faith estimates based on the carrier, the route, and historical performance. They are not guarantees. Events outside our reasonable control, including weather, civil unrest, customs holds, and carrier disruption, may extend transit, and you accept this risk by booking.
7. Customs duties and taxes
All shipments are subject to the import laws of the destination country. Nigeria applies the ECOWAS Common External Tariff (CET), with ad valorem duty bands at 0%, 5%, 10%, 20%, and 35% depending on the HS classification of the goods, plus 7.5% Value Added Tax on imports and a small statutory levy stack. We classify your goods to an HS code before shipment so duty exposure is known at booking.
Where duty or VAT is assessed at clearance, we will settle it on your behalf and add the cost, without markup, to your shipment invoice. You agree to pay any duty, VAT, or levy assessed by the destination customs authority. Customs assessments are at the discretion of the authority and may differ from the up-front estimate in your dashboard.
8. Cancellation, refunds, claims
You may cancel a shipment from the dashboard at any time before customs export clearance begins. Cancellations after the goods have left the origin warehouse will incur the costs already incurred (handling, consolidation, and any non-refundable carrier fees). Refunds are made to the original payment method within ten business days of cancellation.
If a shipment is lost, damaged, or undelivered, file a claim by writing to trust@shamarrway.com within thirty days of the original estimated delivery date. Verified claims are paid out under the applicable insurance policy.
9. Liability and insurance
Every air shipment includes declared-value insurance at 1.5% of declared value, capped at standard carrier liability limits. Ocean shipments are covered under a separate marine cargo policy. Where insurance pays a valid claim, that payout is your sole monetary remedy from us in respect of the underlying loss.
To the maximum extent permitted by law, Shamarrway's aggregate liability arising out of any single shipment is limited to the lesser of (a) the declared value of that shipment, or (b) the actual proved loss. We are not liable for indirect, consequential, special, exemplary, or punitive damages, or for loss of profit, revenue, or business opportunity, even if we were advised of the possibility of those damages. Some jurisdictions do not allow these limits; in those jurisdictions our liability is limited to the minimum permitted by law.
10. Memberships
Solo is free. Plus, Pro, and Elite are paid monthly memberships that apply a percentage discount to the shipping line of each shipment booked while active, and extend free-storage windows. You may pause for up to ninety days, cancel at the end of the current billing period, or change tier at any time from the dashboard. We do not pro-rate refunds on cancellation. In-flight shipments retain the discount they were booked with.
11. Intellectual property
The Shamarrway name, logo, dashboard, software, and content are owned by Shamarrway or our licensors and protected by intellectual property law. We grant you a personal, revocable, non-exclusive licence to use the Services for your own shipping purposes. You may not copy, redistribute, or reverse-engineer the Services, or use them to build a competing product.
12. Suspension and termination
We may suspend or terminate your account at any time if we reasonably believe you have breached these Terms, attempted to ship a prohibited item, under-declared value, or used the Services for unlawful purposes. You may close your account at any time by writing to hello@shamarrway.com. Provisions of these Terms that are intended by their nature to survive termination do so.
13. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved by good-faith negotiation will be submitted to binding arbitration in Cheyenne, Wyoming under the rules of the American Arbitration Association. Each party bears its own costs. Nothing in this section limits your rights under any consumer-protection law that applies to you and cannot be waived by contract.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced in the dashboard at least fourteen days before they take effect. Continued use of the Services after the effective date means you accept the updated Terms. The current version is always at shamarrway.com/legal/terms.
